General structure of the website

The general structure of the website is the exclusive property of the Établissement Public du Musée du Louvre (EPML). Any reproduction, representation, in whole or in part, use, adaptation, provision, or modification by any process, any person, and any means whatsoever (particularly sales, marketing, rental, etc.) without the express authorization of the EPML, any authors or rights holders is strictly prohibited and constitutes a violation of the French Intellectual Property Code.

Website content

The EPML is assignee of the intellectual property rights and/or holder of the necessary operating authorizations for the distribution of scientific, cultural, and educational content on its website. This content includes, but is not limited to: texts, images, audio recordings, and audiovisual or multimedia documents.
Consequently, any reproduction, representation, in whole or in part, use, adaptation, provision, or modification of this content by any process, any person, and any means whatsoever (particularly sales, marketing, rental, etc.) without the express authorization of the authors or rights holders is strictly prohibited and constitutes a violation of the French Intellectual Property Code.

Trademarks and logos

The trademarks of the EPML and those of its partners, including logos featuring on the website, are official trademarks that have been registered with the intellectual property offices and are protected by industrial property rights.
Any reproduction, in whole or in part, of these trademarks and/or logos made from elements of the website without the express permission of their owners is strictly prohibited and constitutes a violation of the French Intellectual Property Code.

The user is informed that, when visiting the site, a cookie may be automatically installed within his or her browser software. General Terms and Conditions for donations made by SMS

The purpose of the present Terms and Conditions of Use is to define the terms and conditions under which the Musée du Louvre, a public administrative establishment governed by the decree of December 22, 1992, located at “Musée du Louvre, 75058 Paris Cedex 01”, provides donors with an SMS donation service (hereinafter “Service” or “SMS Donation Service”).
The user attests the power, authority, and capacity necessary for the conclusion and execution of the obligations provided for herein. Use of the Service implies full acceptance of these terms and conditions of use.

Definitions

Each of the phrases mentioned below will have the following meaning in the present terms and conditions of use and its annexes:
“Donor” refers to any physical person, holder of a mobile service plan from one of the relevant operators, having made a donation within the framework of the contract hereof.
“Short no./Short Number” refers to a short 5-digit code, 92222, that indicates the Association Française du Marketing Mobile donation Service reserved for use by the Secours Populaire Français.
“Operator” refers to the mobile service providers Bouygues Telecom, Orange, and SFR.
“Service” refers to the SMS donation service, subject to these terms and conditions of use put in place by the Musée du Louvre.
“SMS (Short Message Service)” refers to a messaging service that allows for the sending and receiving of alphanumeric or binary messages from a mobile device.
“Terminal” refers to terminal equipment that may be connected to the radio-electric telecommunications network open to the public.
“SMS-MO” or Short Message Mobile Originated: refers to an SMS sent by a Donor from his or her mobile device.
“SMS-MT” or Short Message Mobile Terminated: refers to an SMS received by a Donor on his or her mobile device.

Article 1 – Object
The Musée du Louvre has set up a system to allow potential donors to make a one-time donation of 5 (five) euros and proposes that such a donation be made by SMS to 92004 via the Service. These General Terms and Conditions of Use lay out the terms and conditions that apply to using the Service.

Article 2 – Use of the Service
The SMS Donation Service allows potential donors to make a donation to the Musée du Louvre via an SMS sent to the Short Number 92004. This number is for the exclusive use of the Musée du Louvre.
2.1   The potential Donor may send the message “LOUVRE” by SMS, or so-called SMS-MO, to the short number 92004. The Donor will then receive an SMS, or so-called SMS-MT, confirming the donation.
Donations via the SMS Service can only be made to the Short Number 92004. An SMS sent to any other number is not the responsibility of the Musée du Louvre.
An SMS with the message “LOUVRE” sent to 92004 corresponds to a donation of 5 (five) euros. Donors can send one or more donations to 92004 up to a limit of €50 per month.
For Donors with a mobile plan from Orange (excluding capped plans), Bouygues Telecom (excluding prepaid plans), or SFR (excluding prepaid and capped plans that do not allow for donations by SMS), the donation(s) made by the Donor will appear on their monthly mobile service invoice after the donations are sent by SMS. The invoice will be edited and sent by the Operator to the Donor. Donations by SMS may be made in mainland France and Corsica only by customers of Bouygues Telecom, Orange, and SFR.
The corresponding amount will be charged cumulatively and concurrently with the payment of amounts due under the mobile plan of the relevant Operator.
For Donors with a prepaid or capped plan, the donation(s) made will be deducted from their credit.
2.2   All donations are tax-deductible (cf. article 5).

Article 3 – Price of Service
There is no surcharge for sending an SMS to 92004; but depending on the Donor’s mobile plan, sending an SMS may entail costs. Donations of five (5) euros by SMS will be collected by the relative Operator and given to the Musée du Louvre.

Article 4 – Terms of Payment
HighConnexion ensures the collection of all donations of five (5) euros from the Donor on behalf of the Musée du Louvre.

Article 5 – Management of Donation Receipts
5.1   All donations made by a Donor entitles the Donor, if he/she so wishes, to a donation receipt.
If the Donor is taxpaying, the donation receipt allows him/her to benefit from a 66% tax deduction, up to a limit of 20% of taxable income.
5.2   If the Donor wishes to receive a donation receipt, he/she must provide their personal contact details one of the following ways:

A donation receipt, corresponding to the cumulative annual amount of donations made by SMS over the previous calendar year, will be sent to the Donor in April of the following year.
5.3   To this end, the Musée du Louvre has put in place measures to identify Donors. Donors may request a duplicate donation receipt by sending an email to
tousmecenes@louvre.fr.
5.4   Regarding the information provided by the Donor relative to the establishment of a donation receipt, the Donor alone is responsible for the accuracy of the information provided and accepts full responsibility with the relevant authorities in the case of false information, whether the error was intentional or accidental. The Musée du Louvre hereby warns the Donor of the risk of using a donation receipt without paying the invoice to his/her mobile device operator.

Article 6 – Commitments and Responsibilities
The Donor agrees to comply with all the stipulations outlined herein. Any complaint or question related to the use of the Service must be addressed to the Musée du Louvre by email at tousmecenes@louvre.fr or by a letter sent by post to: Tous mécènes ! Direction des Relations extérieures – Musée du Louvre, 75058 Paris Cedex 01 France.
The Donor is responsible for all activity carried out from his/her mobile device whether or not it was expressly authorized by him/her.
The Donor agrees not to use the Service in intentional or unintentional violation of any national or international law or regulation in force as well as of any legal act and any other rules having the force of law.
The Donor agrees not to interfere with the use or enjoyment of the Service by other users and not to use the Service to transmit viruses or other harmful programs.
The Donor is and remains solely and fully responsible for the data he/she provides.

Article 7 – Intellectual Property
7.1   The Musée du Louvre is the owner of the French verbal and semi-figurative brands “Louvre” and “Musée du Louvre.”
7.2   Use of the Service does not confer any property or exploitation right to the Donor to any of the brands and/or logos of the Musée du Louvre.
7.3   The Donor agrees not to infringe upon the logos, brands, or other components of the intellectual property of the Musée du Louvre and/or related to the SMS Donation Service.

Article 8 – Personal data
8.1 The Musée du Louvre, in its capacity as data controller, may collect, use, transfer, store or in some other way process your personal data fordans le cadre de la fourniture du Service et le cas échéant pour établir et adresser aux Donateurs les reçus fiscaux.
The EPML processes these data (email address) in accordance with its legitimate interests to encourage donations, and particularly to carry out the following operations:

  • managing and tracking donations;
  • issuing and sending donation receipts;
  • conducting studies and compiling statistics;
  • sending information;

The registered data are reserved for the use of the External Relations Department and may be shared with its subcontracted service providers: iRaiser, Clasis and Ediiscan for the management of donations and the issuing of donation receipts, Edeal for the management of donor relations and Dolist for the dissemination of the newsletter. The personal data collected for these purposes will be stored for a period of three years from the date of the last contact with the donor.

8.2 In accordance with the French Data Protection Act of January 6, 1978 and the General Data Protection Regulation (EU GDPR) of April 27, 2016, you have the right to access, amend, correct or remove data concerning you. You may thus request to have any inaccurate, incomplete, ambiguous or outdated information about you corrected, completed, clarified, updated or erased. You may also exercise your rights to oppose and limit the processing of data, as well as your right to the portability of personal data.

You also have the right of recourse to a national supervisory authority, such as the French Data Protection Authority (CNIL) in the event of a breach of the applicable regulations on data protection.
